No more sleepless nights for Apple’s lawyers, at least not until the Nokia and HTC suits begin to heat up. The company is now the proud owner of a slightly used trademark: iPad™, as of March 17, is no longer a Fujitsu mark and has been assigned to Apple. Much speculation had surrounded the trademark process for iPad, as Fujitsu’s mark was being challenged by Apple as early as September 2009, but it looks like the two companies have come to some sort of agreement. Fujitsu Could Battle Apple Over Ownership of iPad Name

When Apple formally introduced its touchscreen tablet as the iPad Wednesday, it was not the first tech product to carry that moniker — Fujitsu released its own mobile, touchscreen ‘iPAD’ in 2002.

Speaking with The New York Times, Masahiro Yamane, director of public relations for Fujitsu, said it is the company’s understanding that they still own the name ‘iPad.’ Fujitsu is currently consulting with its lawyers over the next steps it may take.

It could become a similar situation to 2007, when Apple formally introduced the iPhone, only to be sued days later by Cisco, which owned the rights to the name. More Hints at Apple’s Desire to Hold ‘iPad’ Trademark

Yesterday, we uncovered evidence that Apple has been pursuing trademarks for the name “iPad”, with some filings occurring as recently as late last week. The move has obviously led to speculation that Apple may be planning to use that name for its tablet device rumored for introduction next week.

At the time, we noted that Apple had not pursued an “iPad” trademark in the United States, ostensibly due to existing claims on the name by Fujitsu for an electronic retail inventory device. While Fujitsu initially filed its trademark application for “iPad” in March 2003, the trademark has yet to be officially accepted, and was in fact classified by the U.S. Patent and Trademark Office (USPTO) as “abandoned” in April 2009 after Fujitsu failed to respond to a request for additional information.
